Terms of Service

These Terms of Service govern your use of Aqualy, hereinafter referred to as the “Application” or “Service,” developed by CLApps. By using Aqualy, you agree to these Terms.

If you do not agree, please do not use the Application.

1. Purpose of the Application

Aqualy is designed to help users track water intake, estimate daily hydration goals, organize hydration routines, view progress, and receive optional reminders.

Aqualy may provide goal estimates and adjustments based on information entered by the user, app settings, weather-related context, and, when permission is granted, supported Apple Health data.

2. Not Medical Advice

Aqualy does not provide medical advice, diagnosis, treatment, or emergency guidance. The Application is intended for general wellness and hydration awareness only.

Hydration needs vary between individuals. You should consult a doctor or qualified healthcare professional before making health-related decisions, especially if you have a medical condition, are pregnant or breastfeeding, take medications, follow fluid restrictions, or have specific hydration needs.

Do not ignore professional medical advice or delay seeking medical care because of information shown in Aqualy.

3. User Responsibility

You are responsible for:

  • Entering accurate information
  • Reviewing hydration goals and reminders before relying on them
  • Deciding whether the app’s suggestions are appropriate for your situation
  • Managing notification, Health, iCloud, and device permissions
  • Consulting a healthcare professional when needed
  • Maintaining backups of your data when appropriate

Aqualy’s calculations and reminders are estimates and may not reflect your actual hydration needs.

4. Apple Health and Permissions

Some Aqualy features may request access to Apple Health or HealthKit data. These features require your permission and are subject to Apple’s system controls.

You can manage or revoke Health permissions at any time in the Health app or in iOS Settings.

Aqualy does not use Apple Health data for advertising, marketing, or data mining.

5. Notifications

Aqualy may provide local notifications as reminders. Notifications are informational only and may not always be delivered at the expected time due to device settings, system behavior, Focus modes, battery conditions, or other factors.

You can manage notification permissions in iOS Settings.

6. Subscriptions and Aqualy Premium

Aqualy may offer optional paid subscriptions, such as Aqualy Premium, through Apple’s in-app purchase system.

Aqualy Premium may unlock additional features, which may include advanced hydration strategies, extended dashboard history, Daily Activity adjustments, and more detailed goal insights.

Subscription billing, renewal, cancellation, refund eligibility, and payment processing are managed by Apple under your Apple ID and App Store settings. Aqualy does not process your payment card information directly.

Subscriptions automatically renew unless canceled according to Apple’s App Store subscription rules. You can manage or cancel subscriptions in your Apple ID subscription settings.

Free features may change over time, and Premium features may be modified, added, or removed as the Application evolves, provided that changes are made in accordance with applicable laws and App Store rules.

7. Free Features

Aqualy may include free features such as hydration logging, basic progress tracking, Apple Watch support, widgets, or iCloud-related functionality, depending on the version and platform availability.

Availability of features may vary by device, operating system version, region, permissions, and technical conditions.

8. Data and Privacy

Your use of Aqualy is also governed by our Privacy Policy, which explains what information may be collected, how it is used, and what choices you have.

Please review the Privacy Policy before using the Application.

9. Acceptable Use

You agree not to misuse Aqualy, including by attempting to reverse engineer, disrupt, damage, modify, or interfere with the Application, its services, or related systems.

You may not use Aqualy for unlawful purposes or in a way that violates applicable laws, App Store rules, or the rights of others.

10. Availability and Changes

Aqualy is provided on an “as is” and “as available” basis. We may update, modify, suspend, or discontinue features at any time.

We aim to maintain a reliable experience, but we do not guarantee uninterrupted or error-free operation.

11. Limitation of Liability

To the maximum extent permitted by law, CLApps shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, Aqualy.

Aqualy’s hydration goals, reminders, charts, and summaries are estimates and should not be treated as medical instructions.

12. Third-Party Services

Aqualy may interact with Apple services such as App Store purchases, HealthKit, iCloud, CloudKit, widgets, notifications, and Apple Watch features. Use of those services may also be governed by Apple’s terms and privacy policies.

Aqualy or the CLApps website may include links to third-party websites or services. We are not responsible for their content, terms, privacy policies, or practices.

13. Intellectual Property

Aqualy, including its design, text, graphics, features, and related content, is owned by CLApps or its licensors and is protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on Aqualy without permission, except as permitted by law.

14. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of Aqualy after changes are posted means that you accept the updated Terms.
